It was not even mine, what do I do?

You call me and we fight it together. One of the smartest things you can do when your charged with having drugs that are not yours is to go get yourself drug tested as soon as possible. A clean drug test and a small amount of drugs can give us a leg to stand on to show it wasn’t yours. Other times the answer is not so simple. For drug possession cases generally, the government has to prove two things, one that what you had was drugs, and two, that you knowingly and intentionally had the drugs in your possession. You need a defense strategy specifically tailored to your case and every case is different..

It’s just a misdemeanor weed charge, why should I hire you instead of pleading guilty?

There are often driver’s license suspensions that come with even misdemeanor weed possession cases. Even if your job wont fire you for the conviction, they will probably fire you if you can’t drive to work for six months. Also, invest in your own future, even though that weed charge might not be a big deal when you’re a teenager, it may be the difference between college admission or denial and getting a job that does not involve flipping burgers.


Many times, courts also impose large fines, supervised probation, community service, drug and alcohol education courses, mandatory drug testing, and will hang jail time over your head if you do not comply with their exhausting list of requirements to not go to jail. Hiring a good attorney can be the difference between getting the case dismissed or paying a simple fine and spending a years worth of weekends picking up trash on the side of the road instead of watching football and spending time with family.

I did not tell them they could search my house or my car, did they violate my rights?

It is highly possible. Police officers most often try to search your home, your car, or your person with your consent. When they cannot get your consent because you know your rights, they often make up B.S. reasons. Lucky for us Body camera and Dash camera do not lie, and we might be able to get the evidence suppressed if the search did not have legitimate probable cause. Unfortunately, many times we cannot definitively tell whether your rights were violated or not until we see all of the evidence. Even if you think the cops did everything right, let us look your case over, there are many things only an experienced criminal lawyer can spot that may be the reason you walk away clean and free or with probation instead of prison time.


The drugs were in the car, but not on me, can I still be found guilty?

Unfortunately yes, you’re still in danger of being charged and prosecuted. If there is anything illegal in the house or car and no one claims sole ownership of it, then police officers can, and most times do, charge everyone in the house or car. This is called “constructive possession.” The ins and outs of a constructive possession case are complex and depend on where it was, what it was, and who and where the owner, driver, passenger, or guest was. Sometimes the police will still charge everyone even if someone claims ownership. These questions are complex and require the guidance of an experienced attorney.
